Student Demonstration Guidelines

Time, Place, and Manner Guidelines for Student Demonstrations at CUNY SPS

CUNY SPS is committed to protecting students' rights to free speech and peaceful assembly while fostering an educational environment that is respectful, inclusive, and conducive to learning. These guidelines clarify how demonstrations and protests can be conducted in a way that balances these rights with the orderly functioning of the institution. Non-SPS affiliated individuals may not demonstrate at CUNY SPS locations.

Time

  • Demonstrations must occur during hours that do not disrupt scheduled academic or administrative activities. For example, protests may be restricted during exams, orientations, or critical operational times.
  • Events should conclude by 8:30 PM unless prior approval has been obtained from the Office of Student Services.

Place

  • Demonstrations are permitted in designated areas such as the SPS large meeting space (Room 407) or outdoor area, where applicable. Use of other areas requires prior approval.
  • Protests are not allowed in classrooms, administrative offices, or other spaces where activities may be disrupted.
  • Access to and from buildings must remain unobstructed at all times.

Manner

  • Demonstrations must be peaceful and respectful. Use of force or threats of violence is strictly prohibited.
  • Amplified sound may only be used with prior approval to prevent disruption to classes or administrative functions.
  • Signs or banners must not block visibility, access, or egress. Their size and placement may be regulated.
  • Damage to CUNY SPS property or property belonging to individuals on the premises is prohibited.

Additional Considerations

  1. Engagement with Student Services: Students planning events or demonstrations are encouraged to consult with the Office of Student Services to ensure compliance with institutional processes and policies.
  2. Compliance with Henderson Rules: Demonstrators are expected to follow the CUNY Rules and Regulations for Maintenance of Public Order (Henderson Rules). These include the right to advocate a position without fear of abuse and the obligation to respect the rights of others.

Accountability

Violations of these guidelines may result in disciplinary action under Article XV of the CUNY Bylaws. Employees may face actions consistent with collective bargaining agreements or CUNY policy. Any conduct violating the law may also be referred to law enforcement.

These guidelines ensure that demonstrations contribute to the intellectual and social environment of CUNY SPS without compromising the institution's primary mission of education and inclusivity.
